Mr. & Mrs. T. thought they were building their dream home in the white village of Casarabonela in the Andalusian countryside inland from Málaga. They did everything correct so they thought. It turned out to be a disaster!

In 2002 they went to estate agents Eagle Globe Property Advice bureau in Fuengirola and in December 2002 agreed to buy a 6,000m2 plot in Casarabonela with house type ‘Europa’ to be built on it.

On 27th March 2003 they signed the purchase contract and paid 79,864.74 euros. According to the contract the vendor is a company named 2004 Zalea Group SL.

In July 2003 they were coerced by the lawyer into buying 4,000m2 more land for 19,230 euros to comply with new legal requirement for a minimum 10,000m2 plot on which to build a house. It is not yet known if this law exists.

They instructed the lawyer that everything must be legal & above board. They were told the Mayor of Casarabonela’s brother must construct the house and that the building license depended on this condition. At one stage they flew to Spain just to see the non-existent architect to position the house and were told the architect was too busy. The neighbouring house was also built by the Mayor’s brother and is exactly the same.

On 24th March 2004 they made the final payment of 14,257.71 euros to the lawyer.

They had paid in total 234,311.82 euros.

They received the keys on 1st June 2004 but have never received an escritura (title deed) for the land or the house. They had no electricity for 13 months after they took possession and have only half capacity now as they have to share the supply with neighbours due to no papers or habitation certificate.

They were always assured by the lawyer that everything was in order and title documents would follow.

They have only a limited water supply because their deposit tank and pump were never completed and installed. They do not have enough water to shower or bath most days

The road contractors demolished their pump house and water deposit tank.

After living in the house for one year they came home one day and found red & green wooden stakes on their land. They discovered that a new main road is to be built across their plot about 30 metres from the house. The existing main road is 1 kilometre away now and the lawyer never told them of the new road. The road plans are dated 1999.

The house is built on a floodplain and has been flooded several times in two years.

The road plans show a 1-metre diameter pipe on the land to drain away water from the new road on to their plot. The new road construction guarantees flooding and the house already has damp.

The road constructors are not interested in the problems and their attitude is: ‘You don’t exist or who’s paying’. They had another builder put up walls for electric gates all were demolished by the road constructors.

They have had no vehicular access to the house or plot for almost one year so all shopping, including heavy butano gas bottles, has to be carried 100 metres in all weathers.

The new road will be higher than their 3-metre fence so they’ll be overlooked.
